Emblems, Scripts, Date Codes and Data Plates: What a US Importer Can and Cannot Have Reproduced
The exposure on a reproduction classic part sits with the US importer of record, not the overseas factory, and it almost never arrives as a lawsuit. It arrives as a detention notice at the port, a marketplace takedown that kills a listing without warning, or a letter from an OEM licensing department. Sorting a classic catalog by which right is in play gives a result most buyers have backwards: design patents — the right everyone worries about because of the collision-parts fight — are the least relevant right on a 1955 to 1975 vehicle, because a US design patent runs 14 or 15 years from grant with no renewal, and those rights lapsed before most of today's restoration shops opened. Trademark is the live right, because trademarks renew forever. Then come two buckets nobody writes about: identity items, and copyright in artwork. This is general commercial information, not legal advice.
Who carries the risk, and what does enforcement actually look like?
You do. The factory sits outside US jurisdiction and outside the entry paperwork; the importer of record is the party CBP notices, the party a marketplace suspends, and the party a licensing department writes to. A Taiwanese factory will generally build whatever drawing you send, including things you should not be sending, and a willingness to quote is not evidence that the part is lawful to import.
Enforcement is mostly quiet. eBay's Verified Rights Owner programme lets rights owners file a notice of claimed infringement; eBay checks it for completeness rather than adjudicating the merits, may remove the listing, then notifies the seller — no hearing first. At the border, goods bearing marks recorded with CBP are detained and seized, with a civil fine keyed to what the genuine article retails for. Calibrate the scale, though: federal enforcement is dominated by modern safety parts, and while trade press reporting on the 2024 US counterfeit-parts campaign put the figure above 211,000 counterfeit automotive parts seized that year with a roughly tenfold rise in airbags, we could not open CBP's own statistics page and found no classic-specific split published anywhere.
One pattern is worth knowing because buyers propose it as a workaround. In a 2024 case announced by the Queens County District Attorney's Office, a seller of replica luxury wheels was charged with trademark counterfeiting after investigators found that, per the complaint, he "typically fulfilled each order by first shipping the rims" and would "then separately ship the stickers, emblems, decals, or plastic inserts bearing a counterfeit car manufacturer logo." Splitting the mark from the part is a known tactic, not a defence.
Which right is actually in play on which part?
Four buckets. Most SKUs land in the first; the trouble concentrates in a handful of parts that are also the ones customers ask for most.

Why are design patents the least relevant right on a mid-century car?
Because they expire and cannot be renewed. 35 U.S.C. §173 sets the term at 15 years from grant for applications filed on or after 13 May 2015 and 14 years for anything earlier, with no maintenance fees and no extension. Whatever design rights covered the shape of a 1965 fender ran out in the late 1970s. Trademark works the other way: the USPTO's maintenance guidance describes renewal between the ninth and tenth anniversaries of registration and "each successive ten-year period thereafter," with no end point. A script registered in 1957 and renewed ever since is exactly as enforceable today. That is the asymmetry — a bare stamped bracket is one thing, the identical bracket with a script cast into it is a different legal object.
Where does the expired-design-patent reasoning stop?
At the model year, which matters if you sell restomod or late-model parts alongside classic. In Automotive Body Parts Association v. Ford Global Technologies (Fed. Cir., 23 July 2019; 930 F.3d 1314), the aftermarket association sought a declaration that Ford's design patents on an F-150 hood and headlamp were invalid or unenforceable, and lost on every theory. The court refused to import trademark's aesthetic-functionality doctrine into design patent law: consumer demand for a part that matches the original does not make the design functional.
It also closed the two doctrines aftermarket makers reach for. Exhaustion applies to design patents, but selling the truck lets the owner repair the hood and headlamps that came on it, not make new ones to Ford's design; and the repair doctrine permits replacing a component, not reconstructing the patented article. The case concerned a current-production truck, so do not read it onto designs that lapsed forty years ago — but for anything recent, the sane route is an established aftermarket channel, not a commissioned run.
How much of an OEM's name can go on your box?
Enough to say what the part fits, which is nominative fair use. As an IPWatchdog analysis of OEM marks in the aftermarket puts it, "courts for decades have allowed aftermarket sellers to use trademarks of original equipment manufacturers ('OEMs') to inform consumers that their replacement parts fit particular OEM products." The four components courts weigh: the use must accurately refer to the trademarked goods; it must not imply endorsement or sponsorship; there must be no easier way to refer to the product; and only so much of the mark may be used as is needed to identify it.
The line moves as you travel past bare description. That analysis is explicit that "when aftermarket sellers use logos of the OEMs, when the use of the OEM trademark extends beyond conveying compatibility, or when aftermarket sellers adopt deceptively similar packaging or numeric designations, courts very well may find likelihood of confusion" — citing General Motors Corp. v. Keystone Automotive Industries, 453 F.3d 351 (6th Cir. 2006), Volkswagen v. Church, 411 F.2d 350 (9th Cir. 1969) and Hypertherm v. Precision Products, 832 F.2d 697 (1st Cir. 1987). And a disclaimer on the box does nothing for the person who sees the part on a car three years later.
What about VIN plates, trim tags, date codes and casting marks?
This is the bucket where we say no and keep saying it. 18 U.S.C. §511 makes it an offence to knowingly remove, obliterate, tamper with or alter an identification number for a motor vehicle or motor vehicle part — a fine, up to five years, or both, with narrow subsection (b) exceptions for scrap processors, repairs where removal is reasonably necessary, and restoring numbers under state law. 18 U.S.C. §2321 reaches trafficking: obtaining a vehicle or part with intent to sell, knowing an identification number has been removed or altered, carries up to ten years.
Whether a particular reproduction tag falls inside or outside those statutes is for a lawyer who has read your facts and your state's law. The commercial point stands on its own: a reproduction cowl tag that leaves your building clearly labelled as a replacement and reaches an auction three owners later as evidence of originality has damaged the segment's pricing, including yours. We will not quote reproduction of VIN plates, data plates, trim tags or factory identity stampings, at any volume, for any price.

What will we put into an RFQ, and what will we refuse?
Refusals first. No VIN plates, data plates, trim tags or factory identity stampings. No logo-, script- or badge-bearing emblems without evidence of a licence — and if you hold one, bring it, because your licensor may have views on where the part is made. No copying artwork out of a service manual, which is somebody's copyright and often the very thing your factory would otherwise work from.
What is left is most of a classic catalog: unmarked structure and sheet metal, brackets and reinforcements, hardware and fasteners, seals and weatherstrip, script-free trim, and the long tail of small stamped, cast and machined parts nobody reproduces outside the top few platforms. Design rights there expired decades ago and no trademark is in play, which makes it the cleanest sourcing category in the segment.
